RULES OF THE ENGLISH SETTER CLUB
- That the Club be called the “English Setter Club”. The object of the Club shall be to promote Field Trials and to adopt such other means as may be deemed advisable for the encouragement of the English Setter.
- That the Club shall consist of an unlimited number of Members, a President, Vice-Presidents, Secretary, Treasurer and a Committee of not more that ten Members, and the President, Vice-Presidents, Secretary and Treasurer shall be ex-officio Members of he Committee.
- The Committee and Officers (with the exception of the President and Vice-Presidents) shall retire annually and be eligible for re-election at the Annual General Meeting. Candidates for Offices and for the Committee must be proposed and seconded and if more than ten names are submitted for the Committee election shall be by secret ballot, the candidates receiving he highest number of votes shall form the Committee for the ensuing year. In the event of two or more candidates receiving equal votes for the last place on the Committee, a further secret ballot shall be held limited to those candidates to fill the last place on the Committee. If there is more than one candidate for the respective offices of President, Secretary or Treasurer, election shall be by secret ballot.
- The Management of the Club shall be vested in the Committee. The committee shall also have the power of making bye-laws and deciding upon all matters in dispute not provided for in the Rules, also of fixing the time, place and conditions for holding Field Trials. The Committee shall have power to fill any vacancy on the Committee, but their selection must receive the approval of the General Meeting next ensuing.
- All accounts to be held by financial institutions governed by the Financial Services Authority or equivalent government body.
- A Committee Meeting shall be held as frequently as required. Three to form a quorum at a Committee Meeting.
- The subscription of a Member shall be Ten Pounds per annum, payable on the 1st of January or within one week after election, and no one shall be entitled to the privilege of Membership whose subscription shall be in arrears. The liability of a Member shall not exceed his annual subscription. Any Member who shall be in arrear of subscription for a period of two years, shall after duly notified by the Secretary, be struck off the list of Members.
- Subscriptions and donations after payment of all expenses shall be applied to Field Trials of for any special purpose selected by the Committee.
- That accounts be opened in the name of “the English Setter Club” and all monies received by the Treasurer or Secretary on account of the Club, are to be lodged to the credit of the accounts. All payments made by cheque to be signed by two of the three nominated signatories (the Treasurer, Secretary and named other). The financial year of the Club shall be from 1st January to 31st December.
- Every person shall be eligible for Membership, who on being duly proposed by one member and seconded by another Member of the Club, shall be elected by the Committee or by a General Meeting.
- A Member may resign at will on giving notice in writing to the Secretary, and any Member whose notice has been accepted and who wishes again to become a Member, must be proposed, seconded and elected in the ordinary way as if he had never been a Member. Any Member leaving the Club shall not be entitled to receive back any money he may have paid to or on account of the Club during his Membership or have any claim against the Club.
- An Annual General Meeting of the Club shall be held at which a Statement of Accounts (having been previously examined and audited by duly appointed Auditors) shall be submitted to the Members by the Treasurer. A copy of this statement shall be circulated by the Secretary to each Member with the notice of the Annual General Meeting.
- A Special General Meeting may be called at any time upon request in writing signed by ten Members of the Club. It shall be competent for members, including the Committee, unable to attend at any Meeting to record by letter their opinions, to be read at the Meeting they are unable to attend.
- If for any reason the Club should cease to exist, a decision shall be taken at a General or Special General Meeting with regard to the disposal of any assets of the Club, and such decisions shall be reported to the Kennel Club.
- The Kennel Club shall be the final authority for interpreting the Rules and Regulations of the Club and in all cases relative to canine and Club matters.
- Any Member who shall be suspended and/or disqualified by the Kennel Club and/or any Member whose dog(s) is/are disqualified by the Kennel Club shall ipso facto cease to be a Member of the Club. If the conduct of any Member shall, in the opinion of the Committee of the Club be injurious or likely to be injurious to the character or interests of the Club, the Committee of the Club, may at a Meeting, the notice convening which includes as an object the consideration of the conduct of the Member, determine that a Special General Meeting of the Club be called for the purpose of passing a resolution to expel him. Notice of the Special General Meeting shall be sent to the accused Member giving particulars of the complaint and advising him of the place, date and hour of the Meeting that he may attend and offer an explanation. If at that Meeting a resolution to expel is passed by a two-thirds majority of the Members present and voting, his name shall be forthwith erased from the list of Members, and he shall thereupon cease for all purposes to be a Member of the Club, except that he may within two calendar months from the date of such Meeting appeal to the Kennel Club upon and subject to such conditions as the Kennel Club may impose.
- The Rules of the Club shall not be altered except at an Annual General Meeting or a Special General Meeting and such alterations shall not be brought into force until the Kennel Club has been advised and given its approval of the alterations.
- At least fourteen days’ notice of all Meetings shall be given by the Secretary to Members of the Club. Five shall form a quorum at any General or Special General Meeting.
- The English Setter Club shall not join any Federation of Societies or Clubs.
- The Club will store the information provided by members of their names and addresses and telephone numbers on a computerised membership list. The Kennel Club Regulations require a Society to maintain an up to date list of members and their addresses and if so requested make the list available for inspection by the Kennel Club and Members of the Society. A declaration of the number of members of the Society must be made with Annual Returns. You have a right to access any stored information about yourself under The Data Protection Act. Should any member request a listing of member’s names then that will be provided only when permission has been given by those members that their contact details can be disclosed. Members will have the opportunity to request that their own address be excluded from the Trial Meeting Cards.
- The Officers acknowledge that during the month of January each year Maintenance of Title Fee shall be forwarded to the Kennel Club by the Secretary for the continuance of registration and that by 31st July each year, other returns, as stipulated in Kennel Club Regulations for the Maintenance of Title of Societies and Breed Councils and the Affiliation of Agricultural Societies and Municipal Authorities, will be forwarded to the Kennel Club. The Officers also acknowledge their duty to inform the Kennel Club of any change of Secretary of he Club which may occur during the course of the year.
- No person whilst an undischarged bankrupt may serve on the Committee of or hold any other office or appointment within a Kennel Club Registered Society
